Main Purpose of Job

This position functions as the Minority Business Enterprise (MBE) Manager, in the Office of Equal Opportunity for The Department of Public Safety and Correctional Services reporting directly to the Office of Equal Opportunity Executive Director. The Manager is responsible for the development, implementation, monitoring, evaluation and compliance of the MBE activities for all DPSCS Architectural, Engineering, Construction, Maintenance, Services and Information Technology contracts. DPSCS has approximately 200 active contracts at one time with a combined total of 500 Minority Business subcontractors. Analyze and compile data to develop the monthly State Stat and Governors Office of Minority Affairs (GOSMWBA) Reports and the Annual MBE and Procurement Report as required by Law. As the Departments agency representative, this position works to consistently improve MBE performance throughout the Department and provide compliance and oversight on all prime and subcontractor contacts containing MBE commitments, investigate complaints, resolve contract issues involving MBE firms, collection and submission of MBE program reports and information as required by the Department and other control agencies. Represents the Department before elected and appointed officials, outside agencies, at community, public, outreach events and administrative proceedings. Develops MBE objectives and implements practices, policies, and activities to meet those objectives through interaction with executive staff, directors, agency heads and develops and conducts training, ensures accurate reporting monitoring and compliance of MBE objectives.

POSITION DUTIES

The successful candidate will represent The Office of Equal Opportunity (OEO) in MBE matters at various committee meetings.

Attend legal proceedings relating to investigations of potential fraud, contract compliance, contract disputes and protests.

Chairs the Procurement Review Group for all procurements and prepares determinations for MBE participation for each procurement/contract.

Develops MBE operating procedures and guidelines for implementation statewide to include the Department’s MBE Directive and develops recommendations for improvement of agency MBE Program.

Compiles, interprets and analyzes statistical Financial Management Information System (FMIS) reports to develop monthly reports for the Governor’s Office of Small, Minority and Women’s Business Affairs (GOSMWBA), and the Annual MBE and Procurement Reports as required by Law.

Directs contract monitors on MBE goal and sub goal setting processes.

Reviews and evaluates all agency procurement activities and contracting procedures to ensure compliance with MBW laws and regulations.

Work with the Prime Contractor, Contract Monitor, Procurement Office, AGs Office and the Secretary for approval of MBE Contact Modifications.

Supervise the activities of the MBE Compliance Officer.

Participate in various outreach programs and training activities.

Perform other duties as assigned.

MINIMUM QUALIFICATIONS

Education: A Bachelor's degree from an accredited college or university.

Experience: Five years of experience in administrative staff or professional work. One year of this experience must have involved one or more of the following: the supervision of other employees, overseeing and coordinating the general operations of a unit, applying rules and regulations, or exercising responsibility for the development of policies or procedures.

Notes:

1. Additional experience in administrative staff or professional work may be substituted on a year-for-year basis for the required education.

2. Additional graduate level education at an accredited college or university may be substituted at the rate of 30 semester credit hours on a year-for-year basis for the required general experience.

3. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for-year basis for the required education and experience.

SELECTIVE QUALIFICATIONS

The successful candidate must have two (2) years of experience managing a Minority Business Enterprise (MBE) program.

DESIRED OR PREFERRED QUALIFICATIONS

The following qualifications are preferred, not required:

Experience with Financial Management Information Systems (FMIS).

Experience with procurement processes and procedures.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.

BARGAINING UNIT STATUS

The incumbent in this position is a member of a covered bargaining unit and will be required to pay a bi-weekly service fee to the exclusive representative of the bargaining unit.
