Main Purpose of Job

The main purpose of the Health Occupations Investigator is to serve as the investigator for the Board of Professional Counselors and Therapists( BOPCT). This position functions independently and is directly responsible for planning, case review, investigations, thorough analysis and determining strategy necessary to properly prepare a case for prosecution and/or alternative resolution. This position conducts highly confidential investigations of complaints lodged against health practitioners for fraud, misconduct or incompetence, by patients, other practitioners, attorneys and other individuals. This position documents investigative findings in complete written reports and serves subpoenas and disciplinary sanctions. This position also investigates persons applying for reinstatement of licensure after disciplinary sanctions have been lifted and coordinates investigations with Board Counsel and Prosecutor and Board member liaison if needed.

MINIMUM QUALIFICATIONS

Education: Possession of a bachelor’s degree in the field of criminal justice, criminology, law enforcement or an allied health field, (such as nursing, pharmacy, psychology, social work, nutrition, dietetics, speech pathology, audiology) from an accredited college or university.

Experience: Three years conducting criminal investigations, including the preparation of analyses and reports for use in legal proceedings.

Note: 1. Additional experience as defined above may be substituted on a year-for-year basis for the required education.

2. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in Investigator, Police and Intelligence Specialist classifications or Investigator, Police and Intelligence specialty codes in the criminal investigation field of work on a year-for-year basis for the required experience and education.

DESIRED OR PREFERRED QUALIFICATIONS

The preferred candidate should posses the following:

-Experience planning, performing case reviews, and conducting thorough analysis necessary to properly prepare a case for prosecution and/or alternative resolution.

-Experience with investigations of complaints lodged against health practitioners for fraud, misconduct or incompetence, by patients, other practitioners, attorneys and other individuals.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this class may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Employees in this class may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle.

BARGAINING UNIT STATUS

The incumbent in this position is a member of a covered bargaining unit and will be required to pay a bi-weekly service fee to the exclusive representative of the bargaining unit.
