The current vacancy is located at 6776 Reisterstown Road, Baltimore, MD 21215.  However, this recruitment may be used to fill future vacancies.

Main Purpose of Job

The Management Advocate II (Employee Relations Unit Hearing Officer) position serves as a legal advisor to Secretary of the Department of Public Safety and Correctional Services on Second Step Appeals and renders legally sufficient decisions on Disciplinary Action, Grievance and Dispute Resolution Appeals.  The incumbent also represents the Department of Public Safety and Correctional Services on appeals of grievances, disciplinary actions and dispute resolution complaints before the Department of Budget and Management, the Office of Administrative Hearings (“OAH”) and the Correctional Officers’ Bill of Rights (“COBR”) Hearing Board.  This position makes recommendations to the Secretary of the Department of Public Safety and Correctional Services on the legal sufficiency of Notices of Termination, Notices of Disciplinary Charges (“NODC”) and appeals of terminations.  The incumbent is also responsible for interpreting, reviewing and resolving employee-employer relations disputes arising out of the Collective Bargaining Agreement (“MOU”).

POSITION DUTIES

Investigates as necessary, prepares for presentation and presents DPSCS position on employee termination, grievance and disciplinary appeals, to include motions practice and presentation before the OAH and COBR Hearing Board.

Reviews, investigates and renders legally sufficient written decisions in employee appeals of disciplinary actions.

Schedules and conducts administrative conferences as designee of head of the principal unit and renders decisions related to grievance and dispute resolution complaints appeals.

Reviews facts and determines appropriateness of imposed discipline based on evidence and testimony presented in disciplinary appeals and in accordance with applicable laws, regulations and policies and case precedents.

Represents DPSCS management at lower levels of the complaint process in the Dispute Resolution Procedure of the applicable Memoranda of Understanding.

Assists, advises and trains HR Officers on the correct interpretation and application of personnel law, regulations and DPSCS policies for presentation before the OAH.

MINIMUM QUALIFICATIONS

Education: A Bachelor’s degree from an accredited college or university.

Experience: Two years representing management before an administrative law judge in hearings at the Office of Administrative Hearings, or similar adjudicatory settings that involve all types of grievance and disciplinary appeal cases, including terminations, on a regular and recurring basis.

Note: Possession of a Juris Doctor (J.D.) degree from an accredited law school may be substituted for one year of the required experience.

SELECTIVE QUALIFICATIONS

Applicants must meet this selective qualification to be considered. Include clear and specific information on your application regarding your qualifications.

1 year of litigation experience.

DESIRED OR PREFERRED QUALIFICATIONS

1) Possession of a Juris Doctor (J.D.) degree from an accredited law school.

2) Administrative law experience.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1. Employees in this classification are required to obtain certification in State Personnel Management System policies and procedures and in the functionality of the Statewide Personnel System from the Office of Personnel Services and Benefits, Department of Budget and Management within six months from the time of appointment to the position. Employees are also required to obtain recertification every six months thereafter.

2. Employees in this classification may be assigned duties which require the operation of a motor vehicle.  Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.
