Summary Statement

This is professional level work in the application of the principles and practices of administrative and quasi-judicial proceedings and/or the application and interpretation of administrative/contractual provisions and regulations. A class incumbent supports management and professional staff in the development, interpretation, and administration of agency applicable laws/regulations/contracts.

Nature and Scope

A class incumbent reports to a high level agency official and is responsible for applying, interpreting and ensuring the accuracy of the agency regulatory activities and/or engages in dispute resolution processes. Significant aspects of the work include performing complex research, determining applicable state/federal laws/rules/regulations/precedents and preparing reports and recommending decisions. Work is done without supervision except for preliminary discussions with the superior/agency professional staff. Typically, the solution to a given issue may have significant economic and social impact on a large segment of public/private interests. 

Essential Functions

  • Conducts in-depth, comprehensive research. Reports findings to superior/agency staff  including precedents and applicable state and federal laws/rules/regulations/contracts. Drafts recommended decisions based on findings of fact and applicable laws, rules and regulations.Researches other regulatory matters. Provides written recommendations.
     
  • Presides over hearings, negotiations, and other administrative proceedings. Advises other hearing officers/examiners before, during, and subsequent to hearings, negotiations, etc.
     
  • May direct the post-hearing phase including review of legal briefs submitted by various involved parties. 
     
  • Researches and drafts new and revised contracts/regulations/legislation.
     
  • Leads and engages in mediation/arbitration of regulatory violations, contract enforcement and/or administrative rules and policies.

  • Knowledge of constitutional rights and administrative rules, policies, procedures and processes.

  • Knowledge of the provisions and policies embodied in various statutes, rulings, regulations,  precedents, and orders.
  • Knowledge of public policy administration including concepts and methods.
  • Skill in eliciting information.
  • Skill in performing complex research.
  • Skill in conducting hearings, negotiations and/or other administrative proceedings.
  • Skill in preparing written summations of hearing proceedings or equivalent and justification of rulings/findings.
  • Skill in effective verbal and written presentation/advocacy.
  • Ability to provide guidance and direction to professional staff.
  • Ability to analyze and interpret financial, economic, legal and other technical data.
  • Ability to function as spokesperson/advocate regarding controversial issues.

Job Requirements

JOB REQUIREMENTS for Regulatory Specialist
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Six months experience in policy administration which includes planning, developing, implementing and evaluating policies and procedures.
  2. Three years experience in research which includes systematic study to discover or establish facts.
  3. Six months experience in quasi judicial proceedings.
  4. Three years experience in interpreting laws, rules, regulations, standards, policies, and procedures.
  5. Six months experience in narrative report writing.
