POSITION DUTIES

The incumbent of this position will function as an Assistant Manager in the Hearings and Appeals Section of the Compliance Division.The incumbent will be part of a management team responsible for the overall management of the Section and will serve as a staff advisor to the Chief Deputy Comptroller, Division management, and other Agency personnel on tax issues that are under appeal or are likely to be appealed. Additionally, the incumbent will participate in the drafting and review of proposed regulations which assist the Comptroller in administering the State tax laws. Other duties include: serving as a managing attorney supervising a staff of attorney hearing officers who conduct hearings for appeals of tax assessments for all taxes and fees administered by the Comptroller of Maryland. The incumbent will manage revenue by exercising authority to settle all appeals cases, including fraud cases, within approved guidelines, and will be responsible for ensuring that settlements and final determinations issued by hearing officers comply with all applicable tax laws, regulations, and Comptroller of Maryland policies. The incumbent may also be required to serve in a legal advisory/staff attorney capacity for legislatively mandated commissions or other committees as directed by the Chief Deputy Comptroller and Division management.

MINIMUM QUALIFICATIONS

Education:  Possession of a Juris Doctor (J.D.) or equivalent degree from an accredited school of law.

Experience:  One year of experience ensuring appropriate and consistent interpretation of and application of state and federal tax laws and regulations in a government agency, including direct taxpayer contact, conducting hearings, and issuing written determinations of findings. *

DESIRED OR PREFERRED QUALIFICATIONS

  • Proficiency in performing legal research using both printed and electronic materials
  • Excellent verbal and written communication skills
  • Experience that demonstrates a willingness to provide service to and/or work with the public
  • Knowledge of federal and Maryland state corporate and individual income tax law, Maryland sales and use tax law, and Maryland admissions and amusement tax law
  • One or more years of management experience
  • Possession of Master’s Degree in taxation
  • Demonstrated reliable and predictable attendance

LIMITATIONS ON SELECTION

This recruitment is limited to current temporary, contractual and permanent employees of the Comptroller of Maryland's Compliance Division, who have at least one year of experience as a Tax Consultant I.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

  • Candidates must be admitted to the Maryland Bar, and must be in good standing.
  • Employees appointed to positions in this classification may be assigned duties which require the operation of a motor vehicle.  Employees assigned such duties will be required to possess motor vehicle operator’s license valid in the State of Maryland.

Qualifying applicants are subject to an oral interview. Prior to appointment, the selected candidate must successfully undergo a comprehensive background investigation including a review of criminal, MVA and tax records; and determination of legal authorization to work in the United States or under the United States Immigration Reform and Control Act of 1986.
