Main Purpose of Job

Reviews Unemployment Insurance 'fraud' and 'non-fraud' overpayment cases to determine suitability for referral to:  civil litigation, wage garnishment, criminal court, or Central Collections.  Prepares court documents and monthly reports under the direction of Benefit Payment Control Administrators/Attorneys.  Assists and supports the Administrators on work of related projects.

POSITION DUTIES

Reviews cases received from BPC Claims Investigation/Post Audit Supervisor to determine suitability for referral to Legal Section for Civil/Criminal/Bankruptcy. Checks accuracy of weeks for denial and monetary related issues. Represents the State at Civil/Criminal/Bankruptcy Court and OAH hearings on behalf of agency and Central Collection Unit  to secure ‘judgments’ for recovery of UI overpayments.  Responds to telephone inquiries from claimants and their representatives regarding the legal status of their case. Explains ‘pleas’ available to them, repayment arrangements, and verification of payments received. Verifies and updates claimant addresses via the Maryland Automated Benefits System and/or Motor Vehicles System; verifies dollar amount owed to ensure proper transfer of information into court system. Adjusts interest amounts and monetary stipulations resulting from court decisions.

MINIMUM QUALIFICATIONS

Education: Possession of an Associate of Arts degree from an accredited college or university in paralegal studies to include a minimum of three credit hours in legal research, business law, or tax law.

Experience: Two years of experience in debt collection of delinquent taxes for unemployment insurance contributions, or in debt collection, or as a paralegal or legal assistant performing legal research and preparing legal documents on behalf of an attorney.

Notes:

1. Two years of additional experience as stated above may be substituted on a year-for-year basis for the Associate of Arts degree.

2. Four years of experience as a legal assistant or legal secretary performing legal research or preparing legal documents on behalf of an attorney may be substituted on a year-for-year basis for graduation from an accredited high school or possession of a high school equivalency certificate.

3. A bachelor’s degree from an accredited college or university with a minimum of six credits in legal research, business law, or tax laws and practices may be substituted for the required education and one year of the required experience.

4. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in paralegal specialist classification or paralegal specialist specialty codes in the legal and kindred field of work on a year-for-year basis for the required experience.

BARGAINING UNIT STATUS

The incumbent in this position is a member of a covered bargaining unit and will be required to pay a bi-weekly service fee to the exclusive representative of the bargaining unit.
