Associate Commissioner, Compliance and Enforcement

Introduction

The Maryland Insurance Administration (“the MIA”) is an independent State agency that regulates Maryland’s insurance industry and protects consumers by monitoring and enforcing insurers’ and insurance professionals’ compliance with State law.  Through the diligence of a highly professional staff of financial analysts, accountants, lawyers, law enforcement officers, actuaries, and others, the MIA works to facilitate a strong insurance marketplace where consumers are well informed and treated fairly.  Staff members are subject matter experts who serve as a resource for lawmakers, consumers, and other public and private entities. 

The MIA is charged with a range of responsibilities including the licensure of insurance companies and insurance producers (brokers/agents) operating in Maryland, the conduct of financial examinations of companies to monitor financial solvency, and the review and approval of rates and contract forms.  The MIA investigates reports of consumer fraud and consumer complaints about life, health, automobile, homeowners, and/or property insurance.  Insurance companies are subject to market conduct examinations and other actions to monitor compliance with Maryland law.  The MIA has a unit dedicated to consumer education and outreach, which participates in hundreds of events and reaches thousands of individual consumers annually.

Main Purpose of Job

This position reports directly to the Maryland Insurance Commissioner, and serves as MIA’s senior staff authority on all issues concerning the oversight of domestic and foreign insurance companies and other entities regulated by the Maryland Insurance Administration.  The incumbent will lead the effort to ensure that consumers are treated fairly by regulated entities by monitoring Maryland’s insurance marketplace through market analyses, investigations and examinations in accordance with State law and National Association of Insurance Commissioners (NAIC) guidelines. 

This position oversees a staff of market analysis and enforcement personnel who examine and investigate regulated entities and individuals to ensure compliance with the provisions of the Maryland Insurance Article. The Associate Commissioner - Compliance and Enforcement meets regularly with the Insurance Commissioner to discuss regulatory issues identified through market analyses, referrals from the Life & Health and Property & Casualty units, market conduct examinations, and producer enforcement investigations, and to make recommendations on penalties for significant violations of the Maryland insurance laws and regulations.

The incumbent may be required to travel in-state and out-of-state to meet with senior personnel at the offices of insurance companies or other MIA-regulated entities prior to the commencement of, during, and at the conclusion of on-site examinations.

POSITION DUTIES

This position will: 

  • Establish work priorities of the Compliance and Enforcement unit with the Insurance Commissioner, based on statutory requirements, market trends, consumer complaints, and other relevant factors. 
  • Provide direction to staff involved in comprehensive and targeted market conduct examinations, producer investigations, and other market actions.  
  • Coordinate with other MIA senior staff to ensure thorough and consistent regulatory action and minimize duplication of efforts. ·Serve as a member of the Insurance Commissioner’s senior staff and provide advice in matters pertaining to industry compliance with regulation and laws.  
  • Represent the Administration and the Insurance Commissioner or serve as a member on NAIC committees, task forces, and/or working groups.  
  • Represent the Administration and Insurance Commissioner and provide testimony at legislative hearings.

MINIMUM EDUCATION AND EXPERIENCE REQUIREMENTS

  • Possession of a Bachelor's degree from an accredited four year college or university. 
  • At least 10 years of prior insurance-related governmental or industry regulatory experience, including at least 3 years of supervisory/management experience.
  • Knowledge of Maryland insurance laws and regulations.
  • Excellent written and verbal communication and organizational skills.

DESIRED OR PREFERRED QUALIFICATIONS

  • Prior experience as senior level manager of an insurance company or insurance regulatory agency.
  • Prior investigatory experience or experience performing examinations of regulated entities.
