This is a recruitment for a Staff Attorney II in the Office of Staff Council of the Public Service Commission.

Main Purpose of Job

The position is the intermediate level of work providing legal services to the technical staff of the Public Service Commission. Duties include: representation of Commission technical staff in Commission proceedings, including witness preparation, cross-examination, and brief preparation, and review and development of Staff's positions on public policy, monitoring and enforcement matters. Excellent communication skills required, both oral and written.

POSITION DUTIES

A.  MANAGING CASES

      Participate as Staff Counsel in formal Commission proceedings including:

      (1)  review and analysis of applications and documents filed with the Commission;

            including technical testimony, market monitoring, enforcement, and security issues

            related thereto;                                             

      (2)  review and discussion with members of Technical Staff to identify issues and develop

            Staff’s position; reviewing and revising Staff testimony;

      (3)  conduct formal and informal discovery through the submission of data requests to

            public utilities and other parties;

      (4)  attend evidentiary hearings and conduct direct examination of Staff witnesses and

            cross-examination of witnesses of other parties;

      (5)  perform legal research and prepare briefs, legal memoranda and appeals; and,

      (6)  coordinate procedural aspects, scheduling; and document control.

 

B.  BUCKSHEETS

     Analyze applications submitted by utilities requesting Commission action and

     coordinate and review Staff’s response.

     Discuss with other members of Technical Staff specific problems and policy issues.

     Provide written advice and comment to the Commission concerning questions

     involving application of Public Service Commission Law to specific utilities.

 

C.  PARTICIPATE AS STAFF COUNSEL TO

     Monitor special projects and provide periodic reports to the Commission.

     Discuss specific regulatory problems outside the context of a case with representatives of

     utilities and consumers through informal conferences.

     Attend Commission Administrative Meetings and make oral presentations if required.

     Assist in the preparation of Commission’s regulations.

 

D.  PROFESSIONAL DEVELOPMENT

     Attend conferences, seminars and training sessions; monitor professional journals and

     papers.

 

 

MINIMUM EDUCATION AND EXPERIENCE REQUIREMENTS

Education: Possession of a Juris Doctor or equivalent degree from an accredited school of law.

Experience: One year of experience in a government agency practicing law related to the regulation of public utilities.

Notes:

1. Two years of experience practicing law in a regulated public service industry may be substituted for the required experience.

2. Three years of experience as a practicing attorney may be substituted for the required experience.

 

DEGREE OR TRANSPCRIPTS MUST BE SUBMITTED WITH THE APPLICATION IN ORDER TO VERIFY THE MINIMUM EDUCATION REQUIREMENT.

DESIRED OR PREFERRED QUALIFICATIONS

The ideal candidate should have prior experience as a practicing attorney, with  litigation experience preferred.  Prior experience in the public utility field is a plus.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1. A candidate for a position in this classification must be a member of the Bar in any state or federal jurisdiction at the time of appointment.

2. An employee in this classification must become a member of the Maryland Bar within 18 months of appointment. Failure to obtain Maryland Bar certification within 18 months of appointment will constitute grounds for termination from the position. This requirement is set by the Public Service Commission in accordance with Code of Maryland Regulation 20.07.01.04.

3. An employee in this classification may be assigned duties which require the operation of a motor vehicle. An employee assigned such duties will be required to possess a motor vehicle operators license valid in the State of Maryland.

SPECIAL REQUIREMENTS

State law prohibits employees in this classification from engaging in certain transactions with or having interest in public service companies which may fall under the purview of the Public Service Commission, in accordance with Article 78, Sections 16A and 101 of the Annotated Code of Maryland.
