Main Purpose of Job

The primary purpose of the Management Advocate Supervisor in the HRSD Employee Relations Unit (ERU) is to provide supervision, advice, direction and guidance to Management Advocate(s) I and II (Employee Relations Hearing Officers) in the performance of their duties, which include processing grievance and disciplinary appeals, dispute resolution complaints and termination proposals and appeals for DPSCS and to promote the fair and timely legal disposition of employee-employer and labor relations disputes. The Management Advocate Supervisor position serves as a supervisory and administrative support for the Management Advocate Program Chief (Manager of ERU). In that capacity, the Management Advocate Supervisor is responsible for reviewing and evaluating the work of the Management Advocates, to include assigning cases, reviewing Management Advocate’s Second Step written decisions on grievance, disciplinary and dispute resolution complaint appeals, reviewing and approving leave requests, timesheets and conducting performance evaluations and appraisals. In addition to supervising the Management Advocates, the Management Advocate Supervisor is also responsible for providing advice, assistance, guidance and training to DPSCS’ employees, supervisors, administrators and other management and executives upon request. The incumbent evaluates and makes recommendations to the DPSCS Secretary on the legal sufficiency of proposals for termination of skilled service, management service and special appointment positions in DPSCS.

POSITION DUTIES

Supervision and Evaluation: Reviews, supervises, directs and evaluates the work of Management Advocates, to include assigning cases, reviewing hearing officers' Second Step written decisions on grievance, disciplinary and dispute resolution complaint appeals, reviewing and approving leave requests, timesheets and conducting performance evaluations and appraisals

Hearing Representation: Manage caseloads of appeal, Investigates as necessary, prepares for presentation and presents DPSCS’ position on employee termination, grievance, disciplinary and dispute resolution disputes.

Alternative Dispute Resolution: Represents DPSCS at Settlement Conference before DBM on disciplinary and grievance appeals and participates as a mediator in employee-employee and employee-employer relations disputes

Acting Manager: In the absence of ERU Manager, is responsible for reviewing and processing termination proposals and appeals; reviewing motions and DPSCS' responses to motions and providing advice, guidance and responding to inquiries of the Office of the Secretary, DPSCS administrators, directors and supervisors on the interpretation and application of State law, regulations and DPSCS policies; attending meetings, completing special projects at the request for the Executive Director, serving on work groups as needed, and other duties as assigned.

Second Step Conferences and Decisions: Reviews disciplinary and grievance appeals on behalf of DPSCS Secretary and issues legally sufficient written decisions on all issues presented within specified timeframes

Training: Trains Management Advocates, HR staff and investigators on the policies, procedures and processes for the investigation and imposition of disciplinary actions, investigation of grievance and dispute resolution complaints under the State Personnel Management System, COBR, the Performance Evaluation Program (PEP) and Performance Improvement Plans (PIP)

Other duties as assigned by the Executive Director of the Human Resources Services Division (HRSD)

MINIMUM QUALIFICATIONS

Education: Juris Doctorate (JD) degree from an accredited law school.

Experience:
1 year of experience representing at civil or criminal trials and/or administrative hearings.

For education obtained outside the United States, you will be required to provide proof of the equivalent American education as determined by a foreign credential evaluation service. This evaluation must be submitted with your application.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1. Employees in this classification are required to obtain certification in State Personnel Management System policies and procedures and in the functionality of the Statewide Personnel System from the Office of Personnel Services and Benefits, Department of Budget and Management within six months from the time of appointment to the position. Employees are also required to obtain recertification every six months thereafter.

2. Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

EXAMINATION PROCESS

All persons who meet the minimum qualification will be approved on the certification list and will be placed on the employment (eligible) list for at least one year.
