NATURE OF WORK

A Member Board of Contract Appeals is a member of the three member State Board of Contract Appeals Board appointed by the Governor with the advice and consent of the Senate to five-year terms as defined by State and Finance Article, Division II General Procurement Law, Title 15 Procurement Contract Administration and Dispute Resolution, Subtitle 2 Dispute Resolution, Part II- Maryland State Board of Contract Appeals of the Annotated Code of Maryland.

EXAMPLES OF WORK

Adjudicates bid and contract disputes between State government and contractors or vendors doing business with the State.

Matters involved in bid disputes include the preparation and interpretation of bid specifications, qualifications and selection of bidders, and the bidding process.

Issues in contract disputes include the quality of performance, compliance with contract provisions, compensation, claims and change orders, termination, and any other matter which cannot be resolved.

The Board does not have jurisdiction over the procurement of architectural and engineering services.

The Board may subpoena witnesses and documents and may compel the testimony of witnesses.

Decisions of the Board are subject to judicial review, and any aggrieved party, including a State agency, may appeal a final decision.

This is an Executive Service classification in the State Personnel Management System.  All positions in this classification are Executive Service positions.

This classification is not assigned to a bargaining unit, as indicated by the designation of S (Supervisor), M (Manager), T (Agency Head), U (Board or Commission Member), W (Student), X (Used by Agency or Excluded by Executive Order), or Z (Confidential).  As provided by State Personnel and Pensions Article, Section 3-102 Annotated Code of Maryland, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining.  Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.
