NATURE OF WORK

A Financial Non-Depository Examiner, Advanced is the advanced level of financial examination work.  Employees in this classification examine the accounts, records, consumer transactions and business practices of non-depository financial institutions (i.e., consumer loan, sales finance, installment loan, mortgage lenders, collection agencies, check cashiers, money transmitters and debt management companies) primarily located at the business’ headquarters.  Employees in this classification perform  complete examinations designed to ensure that the financial institutions are in compliance with laws and regulations governing their operations or individual compliance reviews resulting from the receipt of consumer complaints.  Employees in this classification function as Examiners-In-Charge (EIC) with full responsibility for the entire examination team of lower-level Financial Non-Depository Examiners and the completion of the Report of Examination and recommendations for corrective actions of the institutions being examined.

Employees in this classification receive general supervision from a Financial Non-Depository Examiner Supervisor.  The work may require travel throughout the State and in some instances the United States, including overnight travel.

Positions in this classification are evaluated by using the classification job evaluation methodology.  The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the class specification.

The Financial Non-Depository Examiner Advanced is differentiated from the Financial Non-Depository Examiner II in that the Financial Non-Depository Examiner Advanced functions as the Examiner-in-Charge with full responsibility for the entire examination team of lower-level Financial Non-Depository Examiners, while the Financial Non-Depository Examiner II performs the full range of duties and responsibilities under general supervision.  The Financial Non-Depository Examiner Advanced is differentiated from the Financial Non-Depository Examiner Supervisor in that the Financial Non-Depository Examiner Supervisor has supervisory responsibility for lower-level Financial Non-Depository Examiners.

EXAMPLES OF WORK

Functions as Examiner-In-Charge (EIC) with full responsibility for the entire examination team;

Leads and coordinates the activities of an examination team;

Conducts pre-examination briefings with the non-depository financial institution’s senior management staff to discuss changes in management, new products and services, growth plans, and the condition of the institution and local and national economy;

Conducts exit meetings with the non-depository financial institution’s senior management staff to discuss the examination’s findings, individual rating components and provides recommendations for corrective actions;

Ensures that the final examination report contains a written assessment and rating of each component item;

Completes the Examiner’s Comments and Conclusions in the Report of Examination;

Proofs and edits each section of the Report of Examination to determine whether the comments are consistent with the overall assessment of the non-depository financial institution;

Performs other related duties.

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge of the laws and regulations governing all non-depository institutions licensed to operate in Maryland;

Knowledge of the theory, principles and practices of auditing and accounting;

Knowledge of lending policies and practices, loan underwriting procedures and credit administration practices;

Knowledge of business practices and procedures of non-depository institutions;

Knowledge of computerized financial reporting and accounting systems;

Skill in using automated data processing information systems, personal computers and software related to examinations;

Skill in evaluating the accuracy, adequacy and propriety of manual and computerized accounts and reports generated from financial transactions;

Skill in interpreting and applying governing laws, rules, regulations and procedures to specific situations;

Skill in analyzing records and developing specific information associated with the purpose of the examination;

Skill in preparing complete and accurate work papers and narrative reports;

Ability to establish and maintain effective working relationships with other examiners, agency staff, agency management personnel, representatives from the financial services industry, attorneys, and federal officials.

MINIMUM QUALIFICATIONS

Experience: Eight years of experience, four years of experience examining the accounts, records and business practices of non-depository financial institutions or in managerial or professional work in consumer loan, sales finance, installment loan, mortgage lenders, collection agencies, check cashiers, money transmitters and debt management industries and four years of additional regulatory, managerial or professional experience in the financial services industry, consumer credit industry, mortgage lending industry, accounting or auditing work or State or federal regulatory experience in the above industries.

Notes:

1. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university including or supplemented by a total of 24 credit hours in business administration, finance, economics, law, criminal justice or accounting and four years of experience examining or auditing the accounts, records and business practices of non-depository financial institutions or in managerial or professional work in the financial services, consumer loan, sales finance, installment loan, mortgage lenders, collection agencies, check cashiers, money transmitters, debt management and/or law enforcement industries for the required experience.  These credit hours must include a minimum of 6 credit hours in either accounting or auditing.

2. Candidates may substitute the possession of a Juris Doctor degree from an accredited law school, a certificate as a Certified Public Accountant or a Master’s degree in business administration or accounting from an accredited college or university for one year of the required experience.

3. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in logistics specialist classifications or administrative support specialty codes in the financial management or auditing fields of work on a year-for-year basis for the required experience.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Employees in this classification may be required to attend advanced formal training classes. The purpose of this training is to maintain professional job specific proficiency and current knowledge. Some training classes are out-of-State and may require overnight stays.

ACKNOWLEDGEMENTS

Class specifications are broad descriptions covering groups of positions used by various State departments and agencies. Position descriptions maintained by the using department or agency specifically address the essential job functions of each position.

This is a Skilled Service classification in the State Personnel Management System.  All positions in this classification are Skilled Service positions.  Some positions in Skilled Service classifications may be designated Special Appointment in accordance with the State Personnel and Pensions Article, Section 6-405, Annotated Code of Maryland.

This classification is assigned to Bargaining Unit G- Engineering, Scientific and Administrative Professional classes.  As provided by State Personnel and Pensions Article, Section 3-102, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining.  Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.
