A Maryland State Police (MSP) Commercial Vehicle Compliance Technician Supervisor is the supervisory level of work in conducting compliance review, new entrant and preventive maintenance inspections and investigations at commercial carriers’ places of business to ensure compliance and initiate enforcement of applicable State and Federal laws and regulations.  Employees in this classification supervise lower-level MSP Commercial Vehicle Compliance Technicians.

Employees in this classification receive general supervision from a MSP Commercial Vehicle Compliance Manager, a designated administrator or law enforcement officer.  Employees may be required to work evenings, nights and weekends, work a rotating shift and may be subject to call-in duty.  The work may be performed outdoors under varying weather conditions and requires travel throughout the State.  The work is performed at motor carriers’ places of business and may require use of safety equipment, such as protective clothing, eyewear and gloves.  The work may require bending or stooping in confined spaces and carrying specialized tools and testing devices.

Positions in this classification are evaluated by using the classification job evaluation methodology. The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the class specification.

The MSP Commercial Vehicle Compliance Technician Supervisor is differentiated from the MSP Commercial Vehicle Compliance Technician II in that the MSP Commercial Vehicle Compliance Technician Supervisor has supervisory responsibility for lower-level MSP Commercial Vehicle Compliance Technicians while the MSP Commercial Vehicle Compliance Technician II performs the full range of duties and responsibilities under general supervision.  The MSP Commercial Vehicle Compliance Technician Supervisor is differentiated from the MSP Commercial Vehicle Compliance Manager in that the MSP Commercial Vehicle Compliance Technician Manager has supervisory responsibility for MSP Commercial Vehicle Compliance Technician Supervisors.

Supervises lower-level MSP Commercial Vehicle Compliance Technicians;

Plans and coordinates compliance review, new entrant and preventive maintenance inspections and investigations at commercial carriers’ places of business as mandated by the Federal Motor Carrier Safety Regulations (FMCSR) to ensure compliance and initiate enforcement of applicable State and Federal laws and regulations;

Monitors and interviews carrier officials and employees to ascertain pertinent compliance information and reporting requirements;

Reviews and examines motor carrier records to determine evidence and location of driver qualifications, vehicle maintenance and hours of service schedules, accident registers, hazardous materials transportation logs, and drug/alcohol testing;

Conducts investigations and safety inspections in response to concerns and complaints from citizens, community organizations, law enforcement officials, businesses, and government agencies to determine if violations exist and document findings, which support or disprove allegations;

Interviews witnesses, complainants, and alleged violators to verify and obtain information related to violations;

Initiates enforcement of applicable laws and regulations by issuing warning notices, notices of violations, fines, corrective action or stop work orders for commercial carrier drivers or commercial carrier business operations;

Prepares and maintains compliance reports of inspections and investigations, and logs, manuals, and files;

Recommends course of action for violation case disposition such as closure of file due to compliance, continuance of inspection activities or referral of case for civil or criminal prosecution;

Conducts commercial motor carrier consulting conferences, seminars, and workshops;

Conducts Inspection Repair Audit Program (IRAP) follow-up enforcement for carriers failing to comply with FMCSR Section 396.(9)(d)(3); Conducts commercial vehicle safety inspections;

Assists investigative agencies of federal, State and local governments in commercial motor vehicle (CMV) related accidents to obtain information concerning involved carrier or driver operations;

Conducts new entrant Safety Assurance Program (SAP) for Federal Motor Carrier Safety Administration (FMCSA) throughout the State;

Attends in-service and out-of-service training to maintain knowledge of compliance requirements and to maintain certifications such as the North American Driver Vehicle Level I-V inspections, cargo tank inspections, hazmat inspections and motor coach inspection;

Testifies at administrative hearings or in court proceedings concerning findings of compliance inspections and investigations;

Performs other related duties.

Knowledge of commercial motor vehicle operating systems, mechanical malfunctions and repair requirements;

Knowledge of the principles and practices of reviewing commercial carrier business records;

Knowledge of commercial vehicle inspection, State and federal commercial vehicle laws and regulations, highway hauling permits, safety requirements and applicable hazardous materials regulations;

Skill in lifting, transporting, using and maintaining testing equipment and specialized tools;

Skill in assessing the safe operation and maintenance of commercial and freight motor vehicles;

Ability to supervise;

Ability to understand, interpret, and apply commercial vehicle regulations and procedures;

Ability to train and become qualified in message terminal and Criminal Justice Information Systems computer operations;

Ability to develop and maintain effective communication with others;

Ability to testify in court concerning motor carrier preventive maintenance investigations.

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Three years of experience in conducting compliance review and preventive maintenance inspections and investigations at commercial carriers’ places of business to ensure compliance and initiate enforcement of applicable State and federal laws and regulations.

Notes:

1. Candidates may substitute additional experience in the mechanical repair, maintenance, or inspection of commercial motor vehicles on a year-for-year basis for the required education.

2. Candidates may substitute additional experience in law enforcement activities including vehicle inspections on a year-for-year basis for the required experience.

1. Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

Employees in this classification must possess and maintain certification as required by State Transportation Article, Title 25, Subtitle 111 (h)(2) Respective Powers of State and Local Authorities, Title 49, Sections 107-108 and 300-399 of the Federal Motor Carrier Safety Regulation and as required by the Commercial Vehicle Safety Alliance guidelines.

1. Employees in this classification are subject to substance abuse testing in accordance with Code of Maryland Regulation 17.04.09, Testing for Illegal Use of Drugs.

2. In accordance with Public Safety Article, Title 2. Department of State Police, Section 2-204 (b)(6) of the Annotated Code of Maryland, candidates for positions in this classification will be subject to an initial drug screening, a physical examination and a complete criminal background investigation, to  include a polygraph examination before permanent appointment can be made.  A criminal conviction may be grounds for rejection of the candidate. 

Class specifications are broad descriptions covering groups of positions used by various State departments and agencies. Position descriptions maintained by the using department or agency specifically address the essential job functions of each position.

This is a Skilled Service classification in the State Personnel Management System.  All positions in this classification are Skilled Service positions.  Some positions in Skilled Service classifications may be designated Special Appointment in accordance with the State Personnel and Pensions Article, 6-405, Annotated Code of Maryland.

This classification is not assigned to a bargaining unit as indicated by the designation of S (supervisor), M (manager), T (agency head), U (Board or Commission member), W (student), X (Used by agency or excluded by executive order), or Z (confidential).  As provided by State Personnel and Pensions Article, Section 3-102, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining.  Additionally, certain executive branch agencies are exempt from collective bargaining and therefore, all positions in those agencies are excluded from collective bargaining.
