Summary Statement

Incumbents administer entire programs relevant to the acquisition and disposition of real property and property rights for state highway purposes.

Nature and Scope

Work is performed under the direction of the Chief, Right-of-Way. A class incumbent manages district-wide section operations or major statewide section operation. Assignments can be given in any combination in response to the needs of the section for supervision, direction, review and training.

Essential Functions

  • Provides technical and administrative supervision for a district or statewide staff unit responsible for one or more of the following right-of-way operational specialty areas:  appraisal, appraisal review, negotiation, technical services, relocation or property management.
     
  • Assigns work to subordinate agents, office personnel and fee appraisers to complete assignments in accordance with workloads, schedules and priorities, ensuring effective and efficient use of personnel.
     
  • May directly conduct appraisal, negotiation, relocation or technical service activities for special client situations.
     
  • Ensures that subordinate agents are given training and experience essential to effective and efficient completion of present and future assignments.
     
  • Recommends new or revised operating policies and procedures; works with Federal Highway Administration officials in implementing changes in laws and regulations.
     
  • Serves as the Assistant Chief, Right-of-Way to direct and represent the office in the absence of the Chief, Right-of-Way.
     
  • Coordinates with other Department sections to obtain and clear right-of-way in time to permit the Department's Bridge and Highway Program to proceed on schedule.

  • Knowledge of State and federal laws, rules and regulations applicable to assigned programs.
  • Knowledge of Department and Federal Highway Administration goals, objectives, policies and procedures as related to program area.
  • Knowledge of real estate principles and practices as related to program area.
  • Knowledge of land economics, the effects of economic trends and real estate construction costs.
  • Ability to plan, organize and direct the work of right-of-way staff.
  • Ability to conduct difficult right-of-way negotiations with owners or their representatives.
  • Ability to testify as expert witness on matters related to program area.
  • Ability to establish and maintain an effective working relationship with Department sections, other agency officials, State and federal government officials, the public, the media and subordinates.

Job Requirements

JOB REQUIREMENTS for Right-of-Way Agent IV
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Three years experience in interpreting the Federal Uniform Relocation and Real Property Acquisition Act.
  2. Three years experience in real estate negotiation and real property acquisition.
  3. Three years experience in analyzing engineering or property drawings.
  4. Six months experience in preparing real estate cost estimates.
  5. Knowledge of real estate appraisal and real property management.
  6. Knowledge of staff supervision acquired through course work, academic training, training provided through an employer, or performing as a lead worker overseeing the work of others; OR supervising staff which may include planning, assigning, reviewing, and evaluating the work of others; OR supervising through subordinate supervisors a group of professional, technical, and clerical employees.
